Legalność bety 1 z innego źródła niż Microsoft

Właśnie sCooBy^ to cytował. ;) Ale wiesz, jest różnica między instalowaniem z oryginalnej płyty, a z wypalonej w Nero. :)
W końcu fragment licencji, który został tu podany mówił jedynie o tym, że z kopii, którą się posiada można zainstalować system na nieograniczonej liczbie kompów, a nie, że można kopiować tę płytę lub jej obraz udostępnić na torrentach. ;)

co nie zmienia faktu że MicroShit nie dał uzasadnienia dlaczego jest to nielegalne ...

Trzeba by przeczytać licencję. Mogli tam napisać, że rozpowszechniać nie wolno.
